Jako Enterprises, LLC dba Snipes USA ("Sponsor") is pleased to offer the Allen Iverson Eagles Jersey Promotion ("Promotion"). In order to participate in the Promotion, you must agree to these terms and conditions ("Rules").

PLEASE CAREFULLY READ THE RULES BEFORE PARTICIPATING IN THE PROMOTION. THE RULES CONTAIN IMPORTANT PROVISIONS ABOUT THE PROMOTION AND SPONSOR’S OBLIGATIONS WITH RESPECT TO THE PROMOTION. YOU MAY NOT PARTICIPATE IN THE PROMOTION UNLESS YOU AFFIRMATIVELY INDICATE YOUR ACCEPTANCE OF THESE TERMS AS REQUIRED BY SPONSOR.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE PROMOTION. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

1. Promotion Rules.
• How to Enter. In order to enter the Promotion, you must comply with one of the following entry methods:
• SMS Entries. You may enter the Promotion by signing up for text by texting TUNNEL to 764-737 (SNIPES). Additional data and messaging rates and charges may apply to your receipt of text message alerts. Consult your phone plan or mobile services provider for more information about rates and charges.
• How the Winners will be Selected. At the end of the Promotion Period, Sponsor will randomly select a "Winner" from the pool of all entries. Sponsor will contact the Winner on the date the applicable Prize is scheduled to occur using the contact information provided in the winning submission and confirm that the Winner wishes to accept the Prize pursuant to the Prize acceptance terms. If the Winner fails to respond to Sponsor promptly after being contacted, prove to be ineligible under these Rules, or opt not to accept the Prize pursuant to the Prize acceptance terms, Sponsor will select alternative Winners from the pool of entries until it finds a responsive, qualifying Winner who accepts the Prize pursuant to the Prize acceptance terms.
• Prizes. The Winner will, upon confirmation of eligibility, receive one (1) Philadelphia Eagles jersey autographed by Allen Iverson (the "Prize") The estimated retail value of the Prize is $500.00 or less.
2. Sponsor. Sponsor is located at 2030 East Byberry Road, Philadelphia, Pennsylvania, 19116. The Promotion is in no way sponsored, endorsed, or administered by, or associated with, any other entity, including Instagram, Philadelphia Eagles, Allen Iverson (Third Party) or the Third Parties’ affiliates. When you enter the Promotion, you are submitting an entry to Sponsor and not to any other person or entity. All information you provide in connection with the Promotion will be stored, processed, and used in accordance with our privacy policy available at https://www.snipesusa.com/privacy-policy.html.
3. Eligibility. The Promotion is open to natural persons who at the time they enter are (a) 18 years of age or older, and (b) legal residents of the United States of America. Each eligible person who submits an entry into the Promotion shall be referred to herein as an "Entrant." Directors, officers, employees, contractors, and agents of Sponsor and its affiliates and members of their immediate families (spouses, parents, siblings, and children) are not eligible to enter or win. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes an Entrant’s full and unconditional agreement to the Rules. Sponsor’s decisions relating to the Promotion are final and binding in all matters relating to the Promotion.
4. Entry Period.You may submit entries for this Promotion from 2:00 p.m. EDT on Thursday, June 2nd, 2022 to 5:00 p.m. EDT on Thursday, June 30th, 2022 (the "Promotion Period"). Only entries received during the Promotion Period will be accepted. Sponsor’s computer is the official time keeping device for the Promotion. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted, or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human, or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to cancel, postpone, delay or extend the Promotion at any time in its sole discretion.
5. Limits on Entry. You may only enter the Promotion once during the Promotion Period. Entrants who submit more than one entry are automatically disqualified from the Promotion. Use of any automated system, including bots, is strictly prohibited and will result in disqualification. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant's entries and that Entrant may be disqualified.
6. Prizes. Winning the Prize is contingent upon your fulfilling all the requirements in the Rules and agreeing to the prize acceptance terms. The odds of winning depend on the number of the entries submitted. Failure to claim the Prize by the time or in the manner specified in that notification will invalidate any claim to the Prize. The Prize is not transferable. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRIZE IS PROVIDED "AS IS" AND IS NOT EXCHANGEABLE FOR FAIR MARKET VALUE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPONSOR DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE PRIZE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. The Prize may not be substituted for cash. The Winners will be solely responsible for (a) all applicable taxes, fees, and surcharges associated with receipt and/or use of the Prize, and (b) all travel, catering, incidental, and other expenses. After the Winners have been notified and has complied with all of these Rules, Sponsor may announce the Winners on its website, Facebook Page, Twitter or Instagram accounts, or through other media, as it determines in its sole discretion. If due to a printing, production or other error, more Prizes are claimed than are intended to be awarded, the intended Prizes will be awarded in a random drawing from among all verified and validated Prize claims received. In no event will more than the stated number of Prizes be awarded.
7. Publicity. Except where prohibited, all Entrants agree to allow Sponsor to use their names, photographs, likenesses, voices, prize information, and biographical information for publicity and promotional purposes without further compensation in the event the Entrant is one of the Winners. We will maintain a list of Winners for at least six (6) months following the announcement of the applicable Winner’s Prize. After the six-month retention period, Sponsor has no obligation to maintain records of historical Winners.
8. Disputes. The Promotion and these Rules are governed by the laws of the Commonwealth of Pennsylvania, without reference to any applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within Philadelphia County, Pennsylvania. By entering the Promotion, Entrants consent to the exclusive jurisdiction of the courts of Pennsylvania and the federal courts located within Pennsylvania with respect to any action, dispute, or other matter pertaining to or arising out of the Promotion. Entrants agree that (a) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred by them, including costs associated with entering this Promotion, but in no event attorneys' fees, (b) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, and (c) Sponsor’s maximum aggregate liability to any Entrant or Winner shall not exceed $500. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
9. General Rules. Any failure by an Entrant to comply with any of these Rules may result in disqualification from the Promotion. Sponsor has the sole and absolute discretion to disqualify any Entrant. Each Entrant agrees that Sponsor’s decisions regarding any Promotion are final and non-appealable. Sponsor is not responsible for any typographical errors in these Rules or in any other communication surrounding the Promotion or for any technical malfunction or error relating to the Promotion. Sponsor reserves the right to amend or interpret the Rules at any time, upon published notice to participants on its website or within any relevant social media page. ENTRANTS AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS SPONSOR, INSTAGRAM, NIKE, AND THE JORDAN BRAND AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM ANY AND ALL LIABILITY, INCLUDING ANY INJURIES, LOSSES, OR DAMAGES (COMPENSATORY, DIRECT, INCIDENTAL, CONSEQUENTIAL, OR OTHERWISE), ARISING OUT OF THEIR PARTICIPATION IN THE PROMOTION. Any attempt by an individual to undermine the legitimate operation of the Promotion is a violation of criminal and civil laws. In the event such an attempt occurs, Sponsor reserves the right to seek damages from such individual to the fullest extent permitted by law. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Rules or any other promotion or in an unsportsmanlike or disruptive manner. IN NO EVENT SHALL SPONSOR, INSTAGRAM, NIKE or the JORDAN BRAND HAVE ANY OBLIGATION OR LIABILITY WHATSOEVER IN RELATION TO THE PROMOTION OTHER THAN AS SET FORTH IN THESE RULES
